When I refer to "Services" in these Terms, I mean any training, consultation, or related services offered through my Website, over the phone, via email, or through other communication methods. Before using my Services, please read these Terms carefully.

By purchasing, paying for, or otherwise accepting the benefit of any Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are entering into this agreement on behalf of another entity (such as a business), you confirm that you have the authority to do so.

I may update or modify these Terms at any time. If changes are made, I will provide reasonable notice. Your continued use of my Services after such changes constitutes acceptance of the revised Terms.

DOG TRAINING SERVICES
ABOUT MY SERVICES
I provide professional dog training services designed to support both you and your dog in developing essential skills, improving behaviour, and strengthening your bond. My training methods are based on positive reinforcement, ensuring a rewarding and enjoyable learning experience for both dogs and owners.
All training techniques used will prioritise your dog’s well-being, avoiding any harsh or harmful methods. I tailor my approach to suit each dog’s individual needs, temperament, and learning style. While I will guide you in implementing these techniques in your daily interactions, I cannot guarantee a change in behaviour.
In exchange for these Services, you agree to pay the Fees as outlined in these Terms.

BOOKING A TRAINING SESSION
You may book a training session by submitting a booking enquiry via my Website or by contacting me by phone or email (details available on my Website).
Your booking is only confirmed once payment has been received and I have provided written confirmation.
You agree that any information you provide about yourself and your dog during the booking process is accurate and up to date.

TRAINING AGREEMENT
Before I agree to provide training, I will ask for details about your dog, including their history, behaviours, and any relevant health information. This helps me assess whether my services are a good fit for your needs and allows me to tailor training appropriately.
You agree to inform me as soon as possible if your circumstances or your dog’s behaviour changes in a way that may affect training.
By booking a training session, you confirm that:

You are authorised to use the payment method provided at the time of booking.

TRAINING LOCATION
Training sessions may take place at your home, in a public setting, or at another agreed-upon location. The specific location will be discussed and confirmed at the time of booking.
For outdoor sessions, I take every precaution to ensure the training environment is safe and suitable. However, as these locations may include other dogs, people, and natural elements, you acknowledge and accept any associated risks.
If your dog has sensitivities to certain environments, such as busy areas, other dogs, or specific distractions, please let me know in advance so I can adjust training accordingly.
DOG OWNER RESPONSIBILITIES
PROVIDING ESSENTIAL DETAILS
To ensure effective training, the Client must provide accurate and up-to-date information about their dog, including medical history, behavioural concerns, sensitivities, and any other factors affecting training or well-being. The Client must promptly notify me of any changes. I reserve the right to refuse or discontinue training if a dog is unfit due to illness, anxiety, aggression, or other behavioural concerns.
If training takes place at the Client’s home, the Client agrees to provide necessary access. Any keys, access codes, or security details shared will be treated with strict confidentiality and returned upon request.

HEALTH & SAFETY REQUIREMENTS
Dogs must be fully vaccinated (or have a valid TITRE test) and up to date with flea, tick, and worming treatments. If external parasites are found, the Client must seek veterinary advice.
In an emergency, the Client agrees to cover veterinary costs. If urgent care is required, their designated vet may proceed with treatment. In extreme cases where euthanasia is advised, I will make every effort to contact the Client or their emergency contact before proceeding.

COMPLIANCE & LIABLITY
The Client agrees to comply with all relevant laws, including data protection and third-party rights. The Client is responsible for managing their dog's behaviour, including the use of a muzzle if necessary. Failure to disclose behavioural issues may result in liability for damages or medical costs.
Active participation in training is essential. The Client or their representative must be present during sessions unless otherwise agreed.
PAYMENT & FEES
PAYMENT
The Dog Owner agrees to pay the Dog Trainer the fees for the Services. The payment for the Services is due on or before the first day of Services. In the event of non-payment, the Dog Trainer reserves the right to withhold or terminate the Services.

ONLINE PAYMENT PARTNERS
I may use third-party online payment providers to process payments for training services. Payment processing is subject to the terms, conditions, and privacy policies of the payment provider.
You agree that I am not responsible for any loss, damage, or technical issues arising from the payment provider’s platform. I reserve the right to correct or instruct the payment provider to correct any errors or mistakes in processing your payment.
CANCELLATION & TERMINATION
CANCELLATION
To cancel or alter services without incurring a cancellation fee, the Dog Owner is required to provide notice at least 24 hours prior to the planned commencement time and date. If a cancellation is made after this period, a cancellation fee of the full amount may be imposed. If the Dog Owner fails to attend a scheduled training session without providing notice or cancels with inadequate notice on multiple occasions, the Dog Trainer reserves the right to terminate the Agreement. Either party may terminate this Agreement with written notice if the other party breaches any terms of the Agreement. In the event of termination, any prepaid fees for sessions not yet conducted will be refunded on a pro-rata basis, excluding fees for completed sessions and any cancellation fees incurred up to the termination date.
LIABILITY & INDEMNITY
LIMITATION OF LIABILITY
To the maximum extent permitted by law, my liability for any claims, damages, or losses arising from or relating to my training services shall not exceed the total fees paid by the Client in the one month preceding the event giving rise to the claim. I am not liable for any indirect, incidental, or consequential losses.

CLIENT RESPONSIBILITY & INDEMNITY
The Client agrees to indemnify and hold me harmless from any claims, losses, or damages resulting from:

A breach of these Terms by the Client.

The actions or behaviour of the Client’s dog(s).

Any injury or damage caused by the Client’s dog to a third party, another dog, or property.

PERSONAL INJURY
Nothing in these Terms excludes liability for death or personal injury caused by my negligence or that of my employees or representatives.

SERVICE LIMITATIONS
Emma-Jayne Canine Behaviour and Training provides services on an ‘as is’ basis and does not guarantee that:

The website or booking system will be error-free or available at all times.

Messages sent through the website will always be delivered.

Information received through the website is fully secure and confidential.

INTELLECTUAL PROPERTY & MEDIA CONSENT
Photographs or video recordings of training sessions may be taken for promotional purposes, including social media and marketing materials.

If the Client does not wish for photos or videos of their dog to be used, they must inform me before training begins.

By agreeing to these terms, the Client consents to the use of such media unless otherwise stated

RATINGS & REVIEWS
Clients may leave ratings and reviews about their experience. Reviews must be:

Truthful, fair, and accurate.

Based on a genuine service experience within the past 12 months.
Reviews that are deemed inappropriate, offensive, or false may be removed at my discretion.

DISPUTE RESOLUTION
Any complaints should be submitted via email to emmajayne.caninebehaviour@gmail.com.

If a dispute is unresolved after 30 days, it may be referred to mediation in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure.

Mediation will take place in England and, if unsuccessful within 120 days, disputes may be referred to the courts of England.
This clause survives termination of this agreement.
DELEGATION AND
TRANSFER
ASSIGNMENT
No party may assign any of its rights or delegate or assign any of its obligations under these Terms and Conditions without the prior written consent of the other party. However, in the event of unforeseen circumstances, such as inclement weather or a bona fide emergency, Emma-Jayne Canine Behaviour and Training reserves the right to make alternative arrangements to ensure the welfare of the client’s pet(s).

GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. By agreeing to these Terms, both parties irrevocably submit to the exclusive jurisdiction of the English courts, including courts of appeal, for any disputes arising from or in connection with this agreement. Both parties waive any objections to legal proceedings on the basis that they have been brought in an inconvenient forum.

WAIVER
A failure or delay by either party to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights. Any waiver must be in writing and signed by the party granting it.

SEVERANCE
If any provision of these Terms is found to be wholly or partially void, illegal, or unenforceable, that provision shall be severed from the agreement. The remainder of these Terms shall continue to be valid and enforceable to the fullest extent permitted by law.

JOINT AND SEVERAL LIABILITY
If more than one person or entity is responsible for obligations under this agreement, they shall be held jointly and severally liable. This means each person or entity is individually responsible for fulfilling the obligations under this agreement.

GENERAL

Any part of this agreement may be submitted in electronic format and, once acknowledged by the receiving party, shall be considered valid and binding.

Section headings are for reference only and do not affect the interpretation of these Terms.

Where applicable, words indicating one gender include all genders, and words in singular form include the plural and vice versa.
